Seminar course: Property Law Facing the Challenge of the Energy Transition

The energy transition not only makes our energy supply green(er) but also more decentral with small-scale projects instead of big power plants. The energy transition also creates new dependencies, for example between the lessor and the lessee of solar panels or heating systems. Property law and its close neighbour, bankruptcy law, struggle to facilitate the energy transition. With a focus on Dutch law and the home jurisdictions of the participants, this seminar explores the energy-related challenges facing the property law and comparatively discusses the solutions developed in scholarly literature and practice. The seminar addresses the following topics:

  • the energy transition in its legal, economic and political context;
  • a comparative brush-up of the participants’ knowledge on ownership and limited property rights;
  • the legal design of renewable energy projects;
  • the particular challenges posed by condominiums and tenant-landlord relationships;
  • new dependencies in bankruptcy law; and
  • the constitutional protection of property and positive obligations to retrofit buildings.


To gain 1 CFU, short written assignments will be required.

The participation to the seminar and the final examination will permit the acquisition of 1 CFU – ALTRE ATTIVITA’
